Potential Pathways for EB-3 Visa Advancement
Between January 1, 2019 through the latest US Visa Bulletin, the final action dates for Indian EB-3 visas did not move a single day. It is understandable for Indian RNs to be frustrated. However two pieces of US legislation offer hope to those in a perpetual state of waiting.
These two pieces of US legislation are:
- Healthcare Workforce Resilience Act: Introduced on April 30, 2020, by a bipartisan group of four US Senators and in response to the evidenced shortage of US healthcare workers amidst the coronavirus pandemic, this act would authorize the recapture of 25,000 immigrant visas for professional nurses and would allow these visas to be issued in order of the priority date, regardless of per-country limitations. Having support from both Democratic and Republican Senators greatly raises its chance for success!
- The Fairness for High Skilled Immigrants Act: In summary this would eliminate per country caps and eliminate the backlog of retrogressed Indian EB-3 visas.
